Definitions

For the purposes of these Terms and Conditions, the following words and expressions shall have the meanings assigned to each unless the context requires otherwise:

  • E-Store: The website or mobile application owned and operated by Edafat International Trading Company, the official agent of Tchaba Tea in Saudi Arabia, duly registered in the Kingdom of Saudi Arabia, through which tea products are offered for sale.
  • Consumer/Customer: Any natural or legal person who purchases or uses the services and products offered through the E-Store.
  • Products: All types of tea and related items offered for sale through the E-Store.
  • Regulations: All applicable laws, regulations, and guidelines in force in the Kingdom of Saudi Arabia, including but not limited to the E-Commerce Law, the Consumer Protection Law, the Anti-Commercial Fraud Law, and the regulations of the Saudi Food and Drug Authority (SFDA).

Acceptance of Terms

By accessing and using the E-Store or completing a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, which shall constitute a legally binding agreement.

Products and Pricing

  1. All products displayed on the E-Store are genuine and sourced from authorized suppliers.
  2. Prices are listed in Saudi Riyals (SAR) and include Value Added Tax (VAT) at 15% unless otherwise stated.
  3. The E-Store reserves the right to update or modify prices, promotions, or discounts at any time. The applicable price is the one in effect at the time of completing the purchase.

Orders and Payment

  1. Customers must provide accurate and complete information when placing an order.
  2. Payments shall be made through approved electronic payment methods (Mada, Visa, MasterCard, Apple Pay, STC Pay) in accordance with Saudi payment system regulations.
  3. The E-Store reserves the right to cancel any order if false or inaccurate information is provided, or if payment is not successfully processed.

Shipping and Delivery

  1. Shipping is available within the Kingdom of Saudi Arabia only.
  2. Standard delivery time is between two (2) and seven (7) business days, depending on the customer’s location and logistics provider.
  3. The E-Store shall not be liable for any delays caused by courier companies or circumstances beyond its control, including but not limited to weather conditions, force majeure, or unforeseen events.
  4. Shipping fees shall be borne by the customer as specified at checkout, unless free shipping is offered under a promotional campaign.

Return and Exchange Policy

  1. In accordance with the Saudi E-Commerce Law, customers may return products within seven (7) days of receipt, provided that the products are in their original condition, unused, unopened, and with intact packaging.
  2. Opened or consumed food products, or those improperly stored by the customer, are not eligible for return or exchange.
  3. The customer shall bear the cost of return shipping unless the product is defective, damaged, expired, or incorrect.
  4. Refunds shall be processed using the original payment method within fourteen (14) business days of acceptance of the return request.

Warranty and Quality

  1. All products comply with Saudi standards and regulations issued by the SFDA.
  2. If a customer receives a defective, expired, or incorrect product, the E-Store is obligated to replace the product or issue a full refund.
  3. The E-Store shall not be held liable for any health issues arising from misuse of products or failure to follow instructions provided on packaging.

Intellectual Property

  1. All content on the E-Store, including but not limited to text, images, designs, logos, and trademarks, is protected under applicable intellectual property laws.
  2. Any unauthorized use, reproduction, distribution, or publication of such content is strictly prohibited without prior written consent from the E-Store management.

Data Protection and Privacy

  1. The E-Store is committed to protecting customers’ privacy in accordance with the Saudi Personal Data Protection Law.
  2. Personal data (such as name, email, phone number, and address) is collected solely for the purposes of order fulfillment, delivery, and customer service.
  3. Customer information shall not be shared with third parties except for delivery providers, payment processors, or official authorities where required by law.
  4. The E-Store adopts technical and organizational measures to safeguard data from unauthorized access or misuse.

Limitation of Liability

  1. The E-Store shall not be liable for any direct or indirect damages arising from the use of, or inability to use, the products.
  2. Customers are responsible for reviewing product labels, usage instructions, and health warnings before consumption.

Governing Law and Jurisdiction

  1. These Terms and Conditions are governed by the laws and regulations of the Kingdom of Saudi Arabia.
  2. The competent courts of Saudi Arabia shall have exclusive jurisdiction over any disputes or claims arising from or in connection with these Terms and Conditions.

Amendments

The E-Store reserves the right to amend, update, or revise these Terms and Conditions at any time without prior notice. Any changes shall become effective immediately upon publication on the website.
